But sometimes, it’s unavoidable. Workers will face psychosocial hazards.
The burden lies with the company, or PCBU, to manage the risk.
A timely investigation allows PCBU’s to make instant changes to protect workers.
A proactive investigation will also instill confidence within workforce and in doing so, build on a culture of inclusion and trust.
The business is also fulfilling its obligation to manage psychosocial risk.
Why investigate?
Psychosocial hazards have crossed the line into the criminal realm - the mining industry in particular has caught the attention of the media, with headlines such as:

Many companies believe
“if it is a criminal matter then it should be left to the Police to investigate”.
This is not always true….
If the victim does not wish to make a complaint to Police, the matter will not be investigated. Notes may be made Police and intelligence database updated, but without a written victim statement a criminal prosecution cannot progress. Police will not spend resources investigating a matter without a willing victim.
This often leaves PCBU’s with their hands tied - an offence has been alleged but Police will not progress the investigation.
A victim has made an allegation and they are left in limbo with the Police “doing nothing” and the PCBU perplexed by criminal allegations.
Health and Safety branches are not equipped to investigate matters that fall into the criminal category, or those that skirt the bounds. Investigation of such matters requires a greater level of investigative doctrine than traditional workplace investigations which aim to assess the validity of an allegation to a civil level of proof - more likely than not to have occurred.
We go further, as we should, to investigate criminal matters to a higher level - taking a victim centric approach to the investigations and ensuring their side of the story is captured along with every scrap of available evidence.
